These Terms and Conditions ("Terms") govern your use of the website located at yumafencebuilder.com (the "Site") and any fence installation, repair, or related services (collectively, "Services") provided by Complete Yuma Fence ("we," "our," or "us"). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or retain our Services.

By accessing or using the Site, or by signing an estimate, proposal, or work authorization from Complete Yuma Fence, you confirm that you are at least 18 years of age, have the authority to enter into a binding agreement, and agree to be bound by these Terms. These Terms may be updated from time to time. Continued use of the Site or Services after changes are posted constitutes your acceptance of the updated Terms.
Complete Yuma Fence provides fence installation, repair, replacement, and related services to residential and commercial customers in the Yuma, AZ area. All Services are subject to the scope of work described in a signed written estimate or proposal. Work performed beyond the agreed scope requires a written change order approved by both parties before the additional work begins.
Written estimates provided by Complete Yuma Fence are valid for 30 days from the date issued unless otherwise stated. An estimate is not a contract until it is signed and accepted by the customer.
Prices in an estimate are based on a site visit and the information available at the time of the visit. If unforeseen site conditions are discovered during the project - including but not limited to underground obstructions, buried utilities not identified by 811 locating services, or soil conditions that require additional equipment - we will notify you before proceeding and issue a written change order for any additional cost.
We do not guarantee that final project costs will match verbal estimates or preliminary figures discussed before a site visit. Only written and signed estimates reflect the agreed project price.
Project start dates are scheduled based on crew availability and permit timelines. We will communicate the scheduled start date in advance. Scheduling is subject to change due to weather, permit delays, or factors outside our control.
If you need to cancel or postpone a scheduled project, please notify us at least 48 hours in advance. Cancellation after materials have been ordered or fabricated may result in a restocking or materials fee as outlined in your written estimate.
We reserve the right to reschedule or cancel a project if site conditions make it unsafe to proceed, if permits have not been obtained, or if payment terms have not been met.
Payment terms are specified in each written estimate. In general, a deposit may be required before materials are ordered or work begins. The remaining balance is due upon project completion unless otherwise stated in writing.
We accept payment by the methods listed in your estimate. Checks should be made payable to Complete Yuma Fence. Returned checks may result in a returned check fee.
Invoices not paid within the agreed timeframe may accrue a late fee at the rate specified in the written estimate or, if not specified, the maximum rate permitted by Arizona law. We reserve the right to pursue collection of unpaid balances through available legal channels.

Where required, Complete Yuma Fence will apply for the necessary building permits from the City of Yuma or the applicable local authority. Permit fees are the responsibility of the customer and will be included in the written estimate. Work will not begin until required permits are approved unless the customer expressly waives this requirement in writing. We are not responsible for delays caused by permit office processing times.
Any warranty on workmanship will be specified in the written estimate or project agreement. Where no specific warranty period is stated, we warrant that our workmanship will be free from material defects for 1 year from the date of project completion.
Warranties on materials - including but not limited to fence panels, posts, hardware, and coatings - are subject to the terms of the original manufacturer and are not extended or modified by Complete Yuma Fence.
Warranties do not cover damage caused by acts of nature (including wind, flooding, or ground movement), improper maintenance, modifications made by the customer or a third party, or normal wear and tear over time.
The Site is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by Arizona law, Complete Yuma Fence shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of the Site or the Services, including but not limited to lost profits, loss of use, or damage to property not directly caused by our negligence.
Our total liability to you for any claim arising out of or related to a specific project will not exceed the amount you paid us for that project.
If a dispute arises relating to the Services or these Terms, we encourage you to contact us first at info@yumafencebuilder.com so we can work toward a resolution directly.
If a dispute cannot be resolved informally, both parties agree to submit to binding arbitration in Yuma, AZ under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for claims involving intellectual property or payment obligations. Class actions are waived to the extent permitted by law.
These Terms and any disputes arising out of or related to the Site or Services are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Yuma County, Arizona.
